Section 111 of the Medicare, Medicaid and State Children's Health Insurance Program Extension Act of 2007 (SCHIP), signed into law December, 2007, outlines specific requirements for carriers and self-insured individuals, which ensure compliance with the Medicare Secondary Payer statute (MSP). The Centers for Medicare and Medicaid Services (CMS) will begin requiring the electronic capture of certain data on July 1, 2009, with reporting to follow approximately 6 months thereafter.
CMS reporting is a government-mandated process that can potentially affect liability, no-fault and workers compensation claims. Failure to comply with Section 111 carries stiff monetary penalties. Under these requirements, Responsible Reporting Entities (RREs) including all liability, no-fault auto and workers compensation carriers and self-insured plans will be required to register with CMS.
